Actes des colloques organisés, les 17 et 18 mars 2006 à Lyon et les 19 et 20 mai 2006 à Bruxelles, par le Tribunal de commerce de Bruxelles, le Centre européen de la petite et moyenne entreprise de l'Université catholique de Louvain (Louvain School of Management) et le Centre d'études européennes de la faculté de droit de l'université Jean Moulin -Lyon 3. The contract for lease of goods is well known in practical life. Short-time leases of cars, to both businesses and consumers, are perhaps the most striking example, but contracts for temporary use of another person's goods in exchange for rent are common for a wide range of products, like industrial equipment, office machines, leisure boats, sports gear, etc. Long-term leases are often chosen as an alternative to other forms of acquisition of goods ("financial leases"). This book presents a set of Principles of European law on lease contracts within the framework of the Study Group on a European Civil Code. The Principles are closely co-ordinated with other parts of what will become the Draft Common Frame of Reference for European contract law, prepared for the European Commission by several pan-European research teams co-operating in a network of excellence under the sixth Research Framework Programme. The Principles are accompanied by explanatory comments and comparative notes containing information on lease law for 27 European countries as well as on relevant international instruments. Thus, the book is a source to knowledge on existing law, in addition to being a contribution to the analysis of the interplay between general contract law and the law of specific contracts as well as to the discussion of future European private law.

Taking as its starting point the major issues of democracy which are the ongoing concerns of every liberal Western political system, this volume offers a wide-ranging review of democracy in the European Union. It treats the EU as a new type of political system within the tradition of parliamentary democracies, a system which is neither federal nor intergovernmental, and which consequently has unique problems of how to handle democratic requirements. This discussion of the Cross-Border Merger Directive and its implementing legislation in each Member State of the European Union and the European Economic Area provides companies and their advisors with useful insight into the legal framework applicable to, and the tax treatment of, cross-border mergers throughout the European Economic Area. Analysis of the Community rules laid down in the Cross-Border Merger Directive and the Community rules on the tax treatment of cross-border mergers is complemented by chapters on the implementing legislation in each Member State, prepared in accordance with a common format and contributed by a practitioner from each state. Judaism, Christianity and Islam have coexisted in Europe for over 1300 years. The three monotheistic faiths differ in demography, in the moment of their arrival on the continent and in the unequal relations they maintain with power: Christianity was chosen by a large number of inhabitants and became — in spite of important differences according to place and time —a religion of state. The organization of the continent into states and the divisions within Christianity often placed minorities in an unstable and at times painful situation. This partially explains the fight against "heresies", the wars of religions, the expulsion of Jews from several European kingdoms (as well as the expulsion of Muslims from Sicily and the Iberian peninsula), the "Jewish question" in the 19th century up until the Holocaust. Since the 20th century, the debates concerning Islam and concerning public expression of religion are shaped in part by this past. The 13 studies gathered in this volume explore the ways in which states have treated their religious minorities. We study various policies — repression, supervision, integration, tolerance, secularization, indifference — as well as the many ways in which minorities have accommodated the majority’s demands. The relation is by no means one-sided: on the contrary, state policies have created resistance, negotiation (on the legal, political, and cultural fronts) or compromise. Through these precise and original examples, we can see how the protagonists (states, religious institutions, the elite, the faithful) interact, try to convince or influence each other in order to transform practices, invent and implement common norms and grounds, all the while knowing the confessional dimension of "religious" majority and minority does not fully embrace the identity of each citizen in full.
